Working Towards Equality–An Essay on Forms Used to Eliminate Discrimination
State parties emphasizes that eradication of apartheid, all forms of racism, racial discrimination, aggression, neocolonialism, colonialism, foreign occupation, domination and interference in internal affairs of status is essential for full enjoyment of rights of both men and women.
It tries to make full and complete development of country and make participation of women on equal terms with men in all fields. It affirmed the strengthening of international peace and security, mutual cooperation among all states irrespective of their social and economic system, mutual benefit in other countries, realisation of rights of people under alien, colonial domination, foreign occupation to self-determination and independence, as well as progress and respect for national sovereignty and territorial integrity, will promote social progress and development and as consequences will contribute to attainment for full equality and complete disarmament, in particular nuclear disarmament under strict and effective control, it make affirmation of peace and principle of justice.
It make great important contribution to welfare of family and to development of society, the social significance of maternity and role of both parents in the family and in upbringing of children and aware the role of women in procreation should not be basis for discrimination but the upbringing of children requires a sharing of responsibility between and women and society as whole. It determined to implement the principle set forth in the declaration on elimination of discrimination against women.
Article I of convention state the term “discrimination against women” shall mean any distinction, exclusion or restriction made on the basis of sex which has effect of nullifying the recognition, enjoyment or exercise by women on basis of equality of men and women, of human rights and fundamental freedom in political, economic, social, cultural field. Article II State, State parties to pursue all appropriate means and without delay a policy of eliminating discrimination against women comprises-
(i) To adopt legislative and other measures including sanctions where prohibiting discrimination against women.
(ii) To establish legal protection of fights of women on an equal basis with men through competent national tribunal and public institution.
(iii) To take appropriate measures, including legislation, to modify the existing law which constitutes discrimination against women.
(iv) To refrains from engaging in any act of discrimination against women and ensures public authorities and all institution shall act in conformity of obligation.
Article III provides “State parties shall provides or take appropriate measure in political, social, economics and cultural fields to ensure full development and the advancement of women, for the purpose of guaranteeing them the exercise and enjoyment of human rights and fundamental freedom for equality.”
Article IV ensures, “State parties to temporary special measures aimed at accelerating defects equality between men acne women shall be considered discrimination as defined in present convention, but shall in no way entail as consequences the maintenance of unequal standard. These measures aimed it protecting maternity shall not be considered discriminating.
State parties to modify the social and cultural pattern of conduct of men and women. These view of achieving eliminating prejudices and customary and all other practices which based on inferiority. It also ensure family education includes proper understanding maternity, upbringing of children and suppression of all forms of terrifies in women and exploitation of prostitution of women as given in Article V and IV.
Article VII ensure political right to women with equal term with men. It includes voting in all election and public referenda, to participate in the formulation of government policy and the implementation thereof and hold pubic office and performs all function at level of government, to participate in nongovernmental organisation and associated concerned with the public and political life of country. Article VIII, state parties take opportunity measures to ensure women, to represent their government at international level and to participate in work of international organisation.
Article X, state parties shall grant women equal right with men to acquire, change or retain their nationality. They shall not ensure in particular that, marriage to an alien nor shall change of nationality by the husband during marriage automatically change the nationality of wife, force upon her nationality of husband and respect nationality of children.
